Export control and sanctions are subject to constant change: EU sanctions packages, national sanctions packages and the Court of Justice of the European Union clarifying that sanctions are to be interpreted broadly and that it is up to the competent national authorities to assess the respective situation and implement the prohibitions accordingly.
Non-compliance in this area can have various consequences:
- Non-delivery of goods and all related costs, e.g. national customs statistics show that Lithuanian customs rejected 2061 exports and 778 transits just in one month!
- Payment of enormous fines, e.g. three times the value of the goods.
- Confiscation of goods.
- Personal liability of the responsible manager, which varies from country to country and can go as far as imprisonment.
Thus, compliance with export controls in the areas of goods, sanctions, use, and country restrictions requires an export control function that operates efficiently and with legal certainty. The automated execution of controls by means of specific IT tools is indispensable in order to be able to make timely decisions about business transactions or to implement export projects. The internal framework for linking legal requirements, processes and organization with IT is also provided by an export control ICP (Internal Compliance Program).

Michael started his career in the senior ranks of the German customs administration. Later, as Trade Compliance Manager at Intel and Global Manager of Customs Strategy and Governance at the BMW Group, he specialised in international project management in all areas of customs and foreign trade law. Thereby, he established and implemented process and organisational structures, risk management systems and customs-IT.
Enrika Naujoke is CEO of CustomsClear, the European customs and trade compliance knowledge platform. She is editor of the Customs Compliance & Risk Management journal for Practitioners in Europe.
